Version 2026-10 · 8 October 2026
Applicable version
The licence terms, commercial terms and dataset specifications in effect when an order is accepted by Fidelra Africa govern that order.
Updates do not retrospectively amend earlier orders unless Fidelra Africa and the customer expressly agree otherwise in writing.
Synthetic nature of the data
Datasets contain synthetic records generated for research, analytics, AI, simulation and related purposes.
They do not represent actual individuals or reproduce the exact historical experience of an identifiable person.
Dataset specification
The accepted order, quotation or dataset-specific licence defines scope, city, domains, period, format, permitted uses, price and redistribution rights.
Agreement and parties
A written order accepted by Fidelra Africa and the customer defines the parties, release, uses, fees, duration and governing law.
Full current clause
These terms apply when incorporated into a written order accepted by Fidelra Africa and the customer. FCTE is the engine brand; Striped Donkey is the platform.
The order identifies each party’s legal name and notice address, licensed release, cities, domains, permitted uses, fees, delivery, duration and governing law.
An inquiry, download or checkbox does not complete a purchase or activate a commercial data licence.
Licensed materials
The order and delivery manifest identify commercial materials. Public samples have a separate licence; earlier source grants remain valid.
Full current clause
Commercial licensed materials are the synthetic datasets and documentation expressly listed in the accepted order. The release identifier and delivery manifest define what is supplied.
Public demonstrations, future releases, APIs, custom services and generation software are included only when expressly ordered.
New public dataset materials use the separate CC BY-NC 4.0 public dataset policy. Earlier artifact-specific grants, including original reference releases under CC BY 4.0, remain valid. Public-material rights do not grant access to unpublished commercial extracts or expand this order’s scope.
Standard licence
The licence starts when accepted payment conditions are met. It covers the named customer’s agreed internal scope and duration.
Full current clause
After the accepted order's payment conditions are satisfied, Fidelra Africa grants a non-exclusive, non-transferable licence to the named customer for its own internal purposes within the agreed scope and duration. The order must specify whether the licence is perpetual for the identified release or time limited; no renewal or future refresh is implied. Authorized employees and contractors may access the materials only for that customer's work, under equivalent confidentiality and use restrictions. The customer is responsible for their compliance.
Permitted work and outputs
Internal work follows the accepted scope. Commercial model training, external applications, multi-entity access and distribution require express agreement.
Full current clause
Within the accepted scope, the customer may store, query, analyze and integrate the licensed data into its internal research, development, testing and analytical workflows. Backups are permitted with the same access controls. Reports and aggregate findings may be shared where they do not disclose reconstructable record-level data or enable extraction of the licensed materials, and are clearly identified as based on synthetic data. Model training, external applications, multi-entity access and customer-facing distribution must be expressly addressed in the order.
Restrictions
Redistribution, resale, public upload and access by other entities require written authorization. Preserve provenance and follow acceptable-use rules.
Full current clause
Unless separately authorized in writing, the customer must not resell, sublicense, publish, redistribute or transfer raw or substantially reconstructable data; upload it to public repositories; provide access to another legal entity; or remove release, provenance or ownership notices. A services or enhancement purchase does not expand these rights. The customer must follow the Acceptable Use Policy and must not represent a synthetic record as evidence about a real individual.
Ownership and third-party material
Fidelra Africa retains its data and method rights. Original customer analyses remain theirs, subject to data restrictions and third-party notices.
Full current clause
Fidelra Africa retains its rights in the licensed materials, methods and documentation. The customer retains its pre-existing materials and original analyses, subject to the underlying data restrictions. Third-party components and source materials remain subject to their disclosed licences. No rights to third-party material beyond those available to Fidelra Africa are implied. Attribution and third-party notices supplied with the release must be preserved where applicable.
Release quality and fitness
Check the delivered release and report material mismatches. Disclosed limitations form part of the specification.
Full current clause
Fidelra Africa will supply the release and documentation described in the accepted order and warrants that it has the rights required to grant that licence. The customer should verify the delivered manifest and report material mismatches promptly. Fidelra Africa will investigate a substantiated delivery or specification defect and, as appropriate, correct or replace the affected materials or agree an alternative remedy under the order. Disclosed residuals and limitations form part of the specification. Synthetic data does not guarantee real-world accuracy or fitness for an unvalidated decision.
Security and personal data
Protect licensed copies. Customer personal data requires separately agreed handling terms before transfer.
Full current clause
The customer must use reasonable access controls and protect licensed copies against unauthorized disclosure. Synthetic records must not be used to identify or make assertions about real people. If a service requires personal data supplied by the customer, the parties must agree the lawful scope, roles, safeguards and any required data-processing terms before transfer. This licence alone is not a data-processing agreement.
Confidentiality
Protect non-public information and use it only for the agreed purpose. Lawful exceptions follow the full clause.
Full current clause
Each party must protect non-public information disclosed for the order, use it only for the agreed purpose, and limit access to people who need it and are bound to protect it. This does not cover information already lawfully known, independently developed, publicly available without breach, or lawfully obtained without restriction. Legally required disclosure is permitted, with prior notice where lawful.
Breach and termination
Material breach may trigger termination after the stated notice period. Stop terminated uses and return or delete affected copies, subject to legal duties.
Full current clause
A party may terminate for a material breach that remains uncorrected 30 days after written notice, or sooner where an unlawful use or serious security risk requires it. Any immediate suspension must be proportionate to the issue. On termination the customer must stop the terminated use and delete or return affected licensed copies, except a restricted archival copy required by law. Payment obligations already incurred, confidentiality, ownership, restrictions and accrued remedies survive as applicable. The order may specify additional termination rights.
Liability and disputes
The accepted order specifies liability, governing law and dispute procedures. Applicable statutory rights remain protected.
Full current clause
The accepted order must state any agreed liability cap, exclusions and dispute procedure. Nothing in these terms excludes liability or statutory rights that applicable law does not permit the parties to exclude. The parties should first try to resolve a dispute through their named commercial contacts. Governing law and the courts or arbitration forum must be expressly identified in the accepted order; the website does not select them by default.
Document priority and changes
Accepted amendments take priority. Later website changes do not automatically alter existing orders.
Full current clause
Expressly negotiated and accepted order amendments prevail over conflicting standard wording. Data Licensing Agreement 2026-10 governs commercial data rights; Commercial Dataset Terms 2026-10 govern fulfillment; the incorporated Acceptable Use Policy governs conduct.
The accepted versions remain with the order. Later website changes do not automatically amend it. Website inquiries use the contact form; formal notices follow the notice arrangements recorded in the accepted order.

1.
Agreement and parties
A written order accepted by both parties activates the agreement. It identifies the licensed scope, permitted uses, fees, duration and governing law.
Full published clause
These terms apply when incorporated into an order accepted in writing by both the customer and the Fidelra contracting entity identified in that order. FCTE is the product brand. The order must identify each party's legal name and address, the licensed release, cities, domains, permitted uses, fees, delivery scope, licence duration and governing law. Preparing an email request, downloading a summary or checking a box does not complete a purchase or activate a data licence.
2.
Licensed materials
Your order and delivery manifest define the supplied datasets and documentation. Public samples grant evaluation access only.
Full published clause
Licensed materials are the synthetic datasets and accompanying documentation expressly listed in the accepted order. The release identifier and delivery manifest define what is supplied. Public demonstrations, future releases, APIs, custom services and source-generation software are included only if the order expressly says so. Public samples are supplied for evaluation and do not grant rights to the full release.
3.
Standard licence
After the accepted order’s payment conditions are met, the standard licence permits the named customer’s internal work within the agreed scope and duration. It is non-exclusive and non-transferable.
Full published clause
After the accepted order's payment conditions are satisfied, Fidelra grants a non-exclusive, non-transferable licence to the named customer for its own internal purposes within the agreed scope and duration. The order must specify whether the licence is perpetual for the identified release or time limited; no renewal or future refresh is implied. Authorized employees and contractors may access the materials only for that customer's work, under equivalent confidentiality and use restrictions. The customer is responsible for their compliance.
4.
Permitted work and outputs
Internal research and analysis follow the accepted scope. Model training, external applications, multi-entity access and distribution require express agreement.
Full published clause
Within the accepted scope, the customer may store, query, analyze and integrate the licensed data into its internal research, development, testing and analytical workflows. Backups are permitted with the same access controls. Reports and aggregate findings may be shared where they do not disclose reconstructable record-level data or enable extraction of the licensed materials, and are clearly identified as based on synthetic data. Model training, external applications, multi-entity access and customer-facing distribution must be expressly addressed in the order.
5.
Restrictions
Redistribution, resale, public upload and access by other entities require written authorization. Preserve provenance and follow the Acceptable Use Policy.
Full published clause
Unless separately authorized in writing, the customer must not resell, sublicense, publish, redistribute or transfer raw or substantially reconstructable data; upload it to public repositories; provide access to another legal entity; or remove release, provenance or ownership notices. A services or enhancement purchase does not expand these rights. The customer must follow the Acceptable Use Policy and must not represent a synthetic record as evidence about a real individual.
6.
Ownership and third-party material
Fidelra retains its data and method rights. Your original analyses remain yours, subject to data restrictions and applicable third-party notices.
Full published clause
Fidelra retains its rights in the licensed materials, methods and documentation. The customer retains its pre-existing materials and original analyses, subject to the underlying data restrictions. Third-party components and source materials remain subject to their disclosed licences. No rights to third-party material beyond those available to Fidelra are implied. Attribution and third-party notices supplied with the release must be preserved where applicable.
7.
Release quality and fitness
Verify the delivered release and report material mismatches. Disclosed limitations form part of the specification; synthetic data does not guarantee real-world fitness.
Full published clause
Fidelra will supply the release and documentation described in the accepted order and warrants that it has the rights required to grant that licence. The customer should verify the delivered manifest and report material mismatches promptly. Fidelra will investigate a substantiated delivery or specification defect and, as appropriate, correct or replace the affected materials or agree an alternative remedy under the order. Disclosed residuals and limitations form part of the specification. Synthetic data does not guarantee real-world accuracy or fitness for an unvalidated decision.
8.
Security and personal data
Protect licensed copies. Customer personal data requires separately agreed handling terms before transfer.
Full published clause
The customer must use reasonable access controls and protect licensed copies against unauthorized disclosure. Synthetic records must not be used to identify or make assertions about real people. If a service requires personal data supplied by the customer, the parties must agree the lawful scope, roles, safeguards and any required data-processing terms before transfer. This licence alone is not a data-processing agreement.
9.
Confidentiality
Protect non-public information and use it only for the agreed purpose. Lawful exceptions and required disclosure follow the full clause.
Full published clause
Each party must protect non-public information disclosed for the order, use it only for the agreed purpose, and limit access to people who need it and are bound to protect it. This does not cover information already lawfully known, independently developed, publicly available without breach, or lawfully obtained without restriction. Legally required disclosure is permitted, with prior notice where lawful.
10.
Breach and termination
Material breach may trigger termination after the stated notice period. Stop terminated uses and return or delete affected copies, subject to legal retention duties.
Full published clause
A party may terminate for a material breach that remains uncorrected 30 days after written notice, or sooner where an unlawful use or serious security risk requires it. Any immediate suspension must be proportionate to the issue. On termination the customer must stop the terminated use and delete or return affected licensed copies, except a restricted archival copy required by law. Payment obligations already incurred, confidentiality, ownership, restrictions and accrued remedies survive as applicable. The order may specify additional termination rights.
11.
Liability and disputes
Your order specifies liability, governing law and dispute procedures. Applicable statutory rights remain protected.
Full published clause
The accepted order must state any agreed liability cap, exclusions and dispute procedure. Nothing in these terms excludes liability or statutory rights that applicable law does not permit the parties to exclude. The parties should first try to resolve a dispute through their named commercial contacts. Governing law and the courts or arbitration forum must be expressly identified in the accepted order; the website does not select them by default.
12.
Document priority and changes
Accepted amendments take priority. Later website changes do not automatically alter an existing order.
Full published clause
An expressly negotiated and accepted order amendment prevails over conflicting standard wording. Subject to that, the Data Licensing Agreement governs data rights, the Purchase & Services Terms govern fulfillment, and the Acceptable Use Policy governs permitted conduct. The accepted document versions are retained with the order. Later website revisions do not automatically amend an existing order. Questions and notices may be sent to fidelra.africa@fidelra.ai and the formal notice addresses identified in the order.
